1. Introduction

Welcome to Mike Pietrzak Coaching (doing business as CoachAI). These Terms and Conditions govern your use of our services and website. By accessing or using the service, you agree to be bound by these terms.

2. Services

Our platform provides AI-driven personal and professional coaching services. The services are for informational and educational purposes only and are not a substitute for professional medical, financial, or legal advice.

3. User Accounts

To use certain features of our service, you must register for an account. You are responsible for safeguarding your account password and for any activities or actions under your account. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

4. Third-Party Services

CoachAI integrates with third-party services, including Google Calendar, WhatsApp, and SMS messaging providers, to deliver its core functionality. Your use of these integrations is also governed by the respective third party's terms of service and privacy policies, and you agree to comply with them when using CoachAI. In particular, your use of the Google Calendar integration is subject to Google's Terms of Service and Google's Privacy Policy.

CoachAI is an independent product and is not affiliated with, endorsed by, sponsored by, or officially connected to Google, WhatsApp, Meta, or any other third-party service it integrates with. All product names, logos, and brands referenced are the property of their respective owners.

We are not responsible for any outages, changes, errors, data loss, or other issues in third-party services that may affect CoachAI's functionality. If a third-party service changes its terms, pricing, API availability, or access policies in a way that impacts CoachAI, we may modify, suspend, or discontinue the affected integration without liability.

Privacy, Hosting, and Security

Our Privacy Policy describes how we collect, use, protect, and share personal information. CoachAI is hosted on Base44, which states that platform data is encrypted in transit and at rest and reports ISO 27001 certification and a SOC 2 Type II audit. These assurances relate to Base44 within their respective scope, not an independent certification or audit of CoachAI. The service is not end-to-end encrypted, and no system can guarantee absolute security.

Base44 documents United States storage as its default, with EU or UK storage available for eligible workspaces and apps. This is a description of the provider's options, not confirmation of CoachAI's configured region or a guarantee that all information stays in one country. Storage residency does not determine all processing locations; Base44 and authorized providers of AI, messaging, payments, and connected services may process information internationally, as described in our Privacy Policy.

We do not sell personal information or share mobile information with third parties or affiliates for marketing or promotional purposes. Human coaching is optional; relevant coaching information is shared with a human coach only when you choose to work with and link your account to that coach. Information may also be shared with authorized service providers as needed to run CoachAI or where required by law. You may request access, export, correction, or deletion of your personal information as described in our Privacy Policy, subject to identity verification and applicable legal requirements.

5. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Mike Pietrzak Coaching (doing business as CoachAI) and its licensors. Our trademarks may not be used in connection with any product or service without our prior written consent.

6. Limitation of Liability

In no event shall CoachAI, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service. In no event shall our total aggregate liability to you for all claims arising out of or relating to the use of the Service exceed the total fees you have paid to us in the twelve (12) months preceding the event giving rise to the claim.

7. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

8. SMS Messaging

By opting in through our onboarding form or within the CoachAI platform, you agree to receive text messages from Mike Pietrzak Coaching (doing business as CoachAI) including reminders, accountability check-ins, notifications, and coaching-related updates.

Message frequency varies.

Message and data rates may apply.

You may opt out at any time by replying STOP to any message. Reply HELP for help.

Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes.

9. Age Requirements

CoachAI is intended for individuals 18 years of age or older. By creating an account or using our services, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into this agreement. If we become aware that a user is under 18 years old, we may terminate or suspend the account at our discretion.

10. Refund Policy

CoachAI offers subscription-based services billed either monthly or annually. All fees are charged in advance for the applicable billing period and are non-refundable except as described below.

Coach accounts (Starter, Growth, and Scale plans). These plans are purchased for business purposes and are not subject to Ontario's Consumer Protection Act. All payments are non-refundable. If you cancel your subscription, you will retain access until the end of your current billing period, after which your account will be suspended. No partial-period refunds are issued.

Client accounts (Client plan — monthly). Monthly Client plan payments are non-refundable. If you cancel, you retain access until the end of your current billing period. No partial-month refunds are issued.

Client accounts (Client plan — annual). If you purchased an annual Client plan and wish to cancel, you may request a full refund within 7 days of your initial payment by contacting us at hello@thecoachai.app. After this 7-day window, annual payments are non-refundable for the remainder of the term.

Free trials. No payment is collected during your free trial. If you cancel before your trial ends, you will not be charged.

Exceptional circumstances. We may, at our sole discretion, issue full or partial refunds in circumstances we deem exceptional, including significant service outages within our control. Submitting a request does not guarantee a refund. We may issue account credits in lieu of cash refunds where appropriate. To request a review, contact hello@thecoachai.app with your account details and reason for request. We aim to respond within 3 business days.

Billing errors and duplicate charges. If you believe you have been charged in error, please contact us within 30 days. Verified billing errors will be corrected promptly.

Currency. All prices are listed and charged in United States dollars (USD).

Cancellation. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period.
